HB 251 - Dumping Garbage on Real Estate
Requires a minimum fine of $500 if convicted of this crime. If the defendant is indigent, it requires the court to make the defendant choose either to pay the minimum fine of $500 or perform 100 hours of community service. P.A. 91-409; effective 1-1-2000.
HB 902 - Real Estate License Act of 2000
Repeals the Real Estate License Act of 1983 and replaces it with the Real Estate License Act of 2000. P.A. 91-245; effective 1-1-2000.
HB 1177 - Home Repair Fraud
Creates the Home Repair and Remodeling Act. It requires that a person engaged in the business of home repair or remodeling to furnish to the customer a written contract or work order with a copy of the "Home Repair: Know Your Consumer Rights" pamphlet before initiating home repair or remodeling work for more than $1,000. It also requires that these contractors obtain insurance in specified amounts. It allows the Attorney General or the State's Attorney of any county to enforce the Act. It also amends the Consumer Fraud and Deceptive Business Practice Act to include a violation of the Home Repair and Remodeling Act as a cause of action under this Act. Will appear at 815 ILCS 513/. HB 1688 - Property Conservation Rights
Amends the Real Property Conservation Rights Act to provide that any owner of real property in this State may convey conservation rights in the property to the federal government. Amends the Property Tax Code to provide that any property dedicated as a nature preserve buffer under the Illinois Natural Areas Preservation Act is encumbered by a public easement. Provides that a tax deed issued with respect to any property sold under the Code shall not extinguish or affect any conservation right. Further amends the Real Property Conservation Rights Act to provide that no conservation easement held by a public body shall diminish the powers granted in any other law to acquire and use land for public purposes. Amends the Code of Civil Procedure to provide that the right to just compensation applies to owners of any conservation right where the conservation right is taken or altered.
Amends the Code of Civil Procedure to provide that the right to compensation applies to property subject to a conservation right under the Real Property Conservation Rights Act, and the amount of compensation for the taking of the property shall not be diminished or reduced by virtue of the existence of the conservation right. HB 1778 - Property Tax - Equalization - etc.
Makes numerous changes to the information required on the real estate transfer declaration, the "green sheet," including allowing the Department of Revenue, by rule, to use the declaration in electronic form. P.A. 91-555; effective 1-1-2000.
HB 2042 - Emergency Housing Evictions
Authorizes emergency evictions under existing law if various criminal offenses are committed that cause death or personal injury. P.A. 91-504; effective 8-13-99.
HB 2180 - Property Tax - Indemnity Fund
Provides that any owner of property who sustains loss or damage by reason of the issuance of certain tax deeds and who is barred or is in any way precluded from bringing an action for the recovery of the property shall have a limited right to indemnity; sets out conditions for access to the indemnity fund. P.A. 91-564; effective 8-14-99.
HB 2632 - Land Sales Registration Act of 1999
The Land Sales Registration Act of 1999 replaces the Land Sales Registration Act of 1989. P.A. 91-338; effective 12-30-99.
SB 122 - Land Surveyor Act
Extends the sunset date of the Illinois Professional Land Surveyor Act of 1989 to Jan. 1, 2010. Makes other changes to the act. P.A. 91-132; effective 7-16-99.
SB 331 - Real Estate Timeshare Act of 1999
Repeals the Illinois Real Estate Timeshare Act and replaces it with the Real Estate Timeshare Act of 1999. P.A. 91-585; effective 1-1-2000.
SB 392 - Duties of Trustee of a Charitable Trust
Requires that trustee of a charitable trust that collects funds to benefit a minor or disabled person must report on the trust to the beneficiary's parent or guardian when the trust is formed and every six months thereafter. The guardian of the estate of a minor or disabled person must also report on the trust as part of the guardian's duties under the Probate Act. The trust must also be registered with Attorney General. SB 734 - Residential Cooperatives
Amends the General Not for Profit Corporation Act of 1986 to affect residential co-operatives containing 50 or more single family units located in DuPage County. P.A. 91-465; 8-16-99.
SB 749 - Business Broker Lien Act
The amendment would clarify the procedure for filing a business broker lien on property, including real estate, requiring the notice of lien to be filed with the County Record of Deeds office. P.A. 91-534; effective 1-1-2000.
