NAPERVILLE RESIDENT CO-AUTHORS ARTICLE IN ILLINOIS BAR JOURNAL

Attorney Carla Labunski, a resident of Naperville and an associate at Botti, Marinaccio & DeLongis, Ltd., in Oak Brook and Wheaton, is co-author of an article, "A Practical Guide to Seeking - and Avoiding - Rule 137 Sanctions".

Co-authored with Aldo E. Botti, the article appears in the August 2004 issue of the Illinois Bar Journal, the monthly magazine of the Illinois State Bar Association (ISBA).

Supreme Court Rule 137 imposes on counsel and client the duty to make reasonable inquiry into the facts and laws that support a legal claim or defense before filing pleadings or other documents with the court. In the article, Labunski and Botti describe the rule's purpose and application, suggest ways for practitioners to avoid mistakes that may result in sanctions, and explain what trial and appellate courts look for in a motion for sanctions.
