GENERAL PRACTICE, SOLO, AND SMALL FIRM SECTION COUNCIL
JUNE 19, 2003 MEETING
THE ABBEY ON LAKE GENEVA
Members Present: Bernie Wysocki, Terry Madsen, Brian McPheters, Patrick Kinnally, Judge Edna Turkington-Viktora, Michele Jochner, Michael Goldberg, Julie Ann Sebastian, Wally Kilgus, Don LaBue, David Franks, Tim Duggan, Anne Martinkus, John Phipps, and Dawn Hallsten.

Chair Michele Jochner called the meeting to order at 3:00 p.m. in The Abbey in Fontana, Wisconsin.
Janet Sosin was introduced to the Council as its new staff representative and members introduced themselves to her. Mary McDermott was congratulated on her new position.
Michele Jochner presented outgoing Chair Jim Dunneback a plaque in thanks for his service to the Council and the Council gave him a round of applause.
Roster review. The members of the council were asked to review their information on the roster, marked as Exhibit A and to notify Janet Sosin if there are any corrections.
Minutes. The minutes of the April 12, 2003 meeting were approved as presented.
Section Count. Michele Jochner noted the Section now has a total 1,663 members, which is about a 100-member increase. She noted that financial constraints and adherence to the ISBA rules mean that section membership sets the maximum number of members a council might have.
Chair's Report - Michele Jochner explained she has no formal report but will comment as the meeting progresses on the items before the Council.
Committee Reports.
Practice Transfer Committee - John Phipps is chairing the special ISBA committee on the sale of a practice and he reported that the committee drafted a proposed rule and the board approved it. Additional input from the Professional Responsibilities Committee led to the decision to also submit the ABA model rule because of its national scope and as reinforcement that such rules are a national trend. These will be presented to the Assembly at its Saturday meeting. Chair Jochner commended John Phipps for his service on this committee as well as his long-term commitment to the concept. She also thanked former council member John Maville as well as Bernie Wysocki for their efforts on this committee and noted that the special committee had its genesis in this Council. Michele Jochner congratulated John Phipps for being one of the recipients of this year's Board of Governor's Award.
Newsletter - Chair Jochner highlighted the importance of the newsletter to the section members. Last year our Section published six newsletters and also has two more in the ISBA office ready for publication. Eight issues are also being requested for next year. The council packets include article suggestions and members are requested to let Judge Turkington-Viktora know in advance if there is a need to change the due date of an article. Discussion ensued about the article due schedule as several members turned in articles and others noted that they had already turned in articles that have not been noted. This led to a reminder that each article should be submitted in hard copy to both John and Edna as well as by diskette to John Phipps. John Phipps noted that communication by email needs to be followed up or preceded by a telephone message to sure it is received. Judge Edna Turkington-Viktora said she will email each person when she receives an article so that if a person doesn't hear from her then he or she should follow up to be sure the article has arrived. She also mentioned that additional copies of the newsletter are available to those whose articles are in that publication and could use extra copies for his or her office or practice. Michele Jochner thanked both co-editors for their ongoing devotion to the Section's excellent newsletter.
Special Guest: ISBA President-Elect Terry Lavin visited the Council meeting and shared that our council is key to his plans for the upcoming year because he intends to focus on increasing membership in the ISBA and developing a mentor program for attorneys who would mentor other attorneys. He requested that this Council create a subcommittee or discuss as a general group the mentor program concept and report back its ideas.
Professional Education - Michele Jochner thanked those who are participating in the General Practice seminar tomorrow. Julie Ann Sebastian reported that so far we have proposed the following CLE programs: (1) Administrative Agencies and Discrimination Claims: Causes of Action, Labor and Employment Law for the General Practitioner on September 5th in Chicago (Exhibit E), Mental Health Issues in Juvenile Court (Exhibit H) in October 3, 2003 in Chicago, The seminar will be repeated on October 17, 2003 in Bloomington, (3) Professional Responsibility: New Rules and Current Issues on November 14th in Chicago (Exhibit F), (4) Hanging Out Your Shingle Without Hanging Yourself in Chicago on December 5th geared toward fall admittees plus those in first five years of practice (Exhibit G), and (5) similar seminar held in Collinsville in May 2004 that would be promoted to attract lawyers licensed in February of 2004. Suggestions for other spring seminars are welcome. Julie also would like to hear if members are willing to moderate seminars or speak at seminars. Michele Jochner thanked Julie Ann and Bernie for their efforts working on the seminars with the ARDC.
Legislation - Bernie Wysocki agreed to serve again on this committee, as did Dawn Hallsten and Jim Dunneback. Bernie Wysocki reported that the legislature is adjourned until the fall veto session and the committee had no bills to discuss at this time! Bernie thanked the ISBA support staff for their help in this busy legislative year. Thanks go out to Mary McDermott, Kim Wallner, and Jim Covington. It was agreed that Jim Covington's Legislative Update to the ISBA Listserv dated June 2, 2003 would be included with the minutes of this meeting in the next packet so that members have this report that covers many of the bills we worked on this session. Tim Duggan mentioned that he has talked to ISBA staff about the feasibility of an internet compiled legislative council discussion so that members could see the bill synopsis and then read comments made to date about it. John Phipps suggested that we look into forming a moderated closed discussion group for this purpose.
Publications - Chair Jochner said she'd like to focus on this area this year and has asked ISBA staff if there is an area of need. She thanked Tim Duggan for his work heading up the book of interview forms. Mike Goldberg volunteered to serve on this committee. Discussion ensued regarding possible publication updates.
Old Business.
Internet Liaison - John Phipps reported the newsletter is sent in an email attachment, which avoids the two-months delay of the past.
Unauthorized Practice of Law - Terry Madsen volunteered to head up this committee.
Ancillary Business Rule - John Phipps reported he missed the last meeting.
Special Guest: Irene Bahr, 3rd Vice-President-Elect stopped into our meeting and congratulated us on our seminars.
Tradition of Excellence Award - Don LoBue reported that the committee had an excellent pool of nominations, which made their job both difficult and a pleasure. He noted that Patrick Kinnally, a new Council member, would receive this year's award.
New Business:
Mentorship Subcommittee - Patrick Kinnally, Patrick Ward, Don LoBue, and Mike Goldberg volunteered to serve on this subcommittee.
ISBA cable TV programs - Discussion took place regarding past programs and the need to contact the ISBA to see if we could participate in these programs during the coming year.
ISBA Foundation Fellows Program - Michele Jochner announced that the ISBA has asked that the members of ISBA section councils consider being part of the Fellows program. This involves a commitment of $100.00 for ten years.
Get a Member or Two - Exhibit I of packet is flyer that is a part of the new membership initiative. Discussion ensued regarding past membership initiatives and a couple members recalled the picture of Lincoln with the saying, "A lawyer's time and advice are his stock in trade." that they received when they joined as early members. Tim Duggan noted, "He only knows one non-member!" Janet Sosin noted she is also servicing membership and sees a great synergy between membership and general practice.
Future Meeting Dates - Michele Jochner announced the next meeting will be in Galena and it was decided that August 23rd is the date for this meeting. The next meeting will be held in Chicago at the ISBA office and November 15th was selected for this meeting.
