Court's Rules Committee to air proposals Jan. 22

The Illinois Supreme Court Rules Committee will hold hearings next month on proposals for one new rule and amendments to three others.

The public hearings are scheduled to begin at 10 a.m. Monday, Jan. 22, in room C-500 of the Michael J. Bilandic Building, 160 N. LaSalle St., Chicago. Summaries of the proposals follow.

06-01 (P.R. 0147): New Rule 109. Service of Rules and Orders on Non-Parties; Attachments – service of a rule to show cause why a non-party should not be held in contempt of court or order, and requirement of proof of prior service before attachment.

04-21 (P.R. 0134): Amends Rules 103 (b). Alias Summons; Dismissal for Lack of Diligence – dismissal with prejudice as to a defendant only, but not barring any claim against another party based on vicarious liability for the dismissed defendant's conduct.

06-02 (P.R. 0148): Amends Rule 216. Admission of Fact or of Genuineness of Documents by adding (f) Limitations on Application – in civil actions seeking less than $50,000 or collection of taxes leas than $50,000.

Also amends Rule 222. Limited and Simplified Discovery in Certain Cases, (f) Limited and Simplified Discovery Procedures, (5) refers to Rule 216 requests.

06-03 (P.R. 0149): Amends Rule 214. Discovery of Documents, Objects and Tangible Things, Inspection of Real Estate – party served shall produce requested documents “including in printed form all retrievable information in computer storage.”

The committee comments that the proposal would eliminate confusion created by the 1995 amendment, on the obligation to label documents to correspond with specific requested categories, by affirmatively requiring such labeling.

The proposals have been circulated to ISBA section councils and committees for comment. The Board of Governors will review them at the meeting Friday, Jan. 26, in Springfield and establish positions as needed.
