Dist. Ct. erred in dismissing plaintiffs' proposed class action alleging that defendant operated illegal lotteries to sell and distribute tickets for certain Division I championship tournaments by retaining mandatory service/handling fees regardless of whether applicants received tickets in selection process. Plaintiffs' allegations that retained service fees constituted consideration for chance to win right to purchase highly prized tickets potentially fit within Indiana law's definition of lottery. Ct. also rejected Dist. Ct.'s belief that doctrine of in pari delicto applied to preclude plaintiffs from obtaining any relief due to their participation in defendant's lotteries.
