Begolli v. Home Depot U.S. A., Inc.

In Title VII action alleging that defendant had terminated plaintiff on account of his national origin, Dist. Ct. erred in holding evidentiary hearing and then finding pursuant to said hearing that instant claim was time-barred where defendant had previously elected jury trial on his claim. Plaintiff was entitled to have jury resolve timeliness issue of his claim, along with any other affirmative defense raised by defendant.
