N.D. Ill., E. Div.

Record contained sufficient evidence to support jury’s verdict in favor of defendant-employer in Title VII action alleging that defendant withdrew its employment offer to plaintiff on account of his national origin. Co-workers testified as to several incidents in which plaintiff acted in rude and abusive manner that formed basis for adverse act, and jury was not required to believe plaintiff’s denials with respect to said accusations. Moreover, Dist. Ct. did not abuse its discretion in refusing plaintiff’s proffer of mixed-motive jury instruction where defendant based its defense on its denial that national origin played any role in adverse act, and where plaintiff insisted that defendant’s proffered reason for withdrawing employment offer was pretext for national origin discrimination.
