Adame v. Holder

Federal 7th Circuit Court

Citation
Case Number:
No. 13-2405
Decision Date:
August 12, 2014
Federal District:
Petition for Review, Order of Bd. of Immigration Appeals
Holding:
Petition dismissed and denied in part.
Ct. of Appeals lacked jurisdiction to consider alien’s appeal of Bd.’s denial of alien’s request for cancellation of removal since: (1) courts of appeal generally lack jurisdiction to review denials of requests for discretion relief such as instant request for cancellation of removal; and (2) instant appeal basically concerned alien’s challenge to Bd.’s application of law to facts of case, especially where alien claimed that IJ could not demand that he supply documentary evidence to establish date of alien’s entry into U.S. Ct. similarly held that it lacked jurisdiction to review IJ’s finding that alien lacked sufficient moral character/hardship on family to warrant cancellation of removal relief.
