Dist. Ct. erred in granting defendant's motion for summary judgment in Title VII action alleging that defendant terminated plaintiff on account of his race, where Dist. Ct. found that plaintiff had sued wrong entity, and that another close-related entity was actually plaintiff’s employer. Instant pro se complaint referred to both entities as plaintiff’s employer in text of complaint, and record showed that same individual was registered agent for both entities. As such, Dist. Ct. should have allowed plaintiff opportunity to amend complaint to add second entity as second defendant, where second entity had timely notice of complaint and would not otherwise have been prejudiced by filing of amended complaint.
