Dist. Ct. erred in granting defendant’s motion for summary judgment in action by plaintiffs-truck drivers seeking determination as to whether plaintiffs were employees or independent contractors of defendant under Kansas Wage Payment Act (KWPA). Ct. of Appeals certified instant question to Kansas Supreme Court, which found that plaintiffs were employees under KWPA as matter of law. As such, Ct. of Appeals reversed Dist. Ct.’s contrary finding, after observing that Kansas Supreme Court’s response to certified question should be regarded as authoritative and binding statement of state law.
