Dist. Ct. did not err in dismissing plaintiff-union member’s breach of contract action, alleging that defendant-employer wrongfully withheld $20,000 from plaintiff according to terms of prior settlement agreement between defendant and plaintiff’s union that had resolved plaintiff‘s grievance against defendant that concerned his discharge. Record showed that plaintiff had previously filed unsuccessful action in Dist. Ct. that challenged both his discharge and legitimacy of settlement, and that although result of said lawsuit established that union could properly enter into instant settlement agreement on behalf of plaintiff, plaintiff could not enforce terms of settlement agreement against defendant, where plaintiff had violated terms of settlement agreement that precluded him from filing any lawsuit that challenged his termination.
