2013 IL App (3d) 130141
Decision Date:
May 24, 2013
District:
3d Dist.
Division/County:
Kankakee Co.
Justice:
SCHMIDT
Holding:
Electoral Board reversed; circuit court affirmed in part and reversed in part.
Electoral Board found that candidate for village clerk was disqualified from candidacy due to his arrearage of $1,456 for village sewer services, and due to his business corporation's unpaid fines for ordinance. violations. Electoral Board erred in finding that candidacy of individual should be barred due to debt of corporation. Electoral Board erred in finding that sewer service amount owed disqualified candidate, as village had not billed him for those services, and thus the amounts owed never became due prior to filing of nominating papers. (WRIGHT and McDADE, concurring in part.)
