Illinois Appellate Court
Civil Court
Employment Discrimination
Plaintiff filed for intentional infliction of emotional distress against his former employer. Court properly granted Defendant's Section 2-619 motion to dismiss, as tort claim is inextricably linked to civil rights violation, and is thus preempted and barred by Human Rights Act. Injury claim is compensable under Workers' Compensation Act, as a physical-mental injury, and is thus preempted and barred by exclusivity provision of Workers' Compensation Act. (CONNORS and SIMON, concurring.)
