Court properly found that allegation in Plaintiff's verified amended complaint that she was terminated from her employment was a judicial admission which was fatal to her cause of action based on single theory of retaliatory failure to recall her to employment. Court properly concluded that complaint and numerous statements, including Plaintiff's letter to employer and agreed statement of the case prepared for trial, indicated that judicial admission of termination was binding and was not result of inadvertence or mistake. Court thus properly granted summary judgment for employer. (HOLDRIDGE and McDADE, concurring.)
