Illinois Appellate Court
Civil Court
Interest
Driver of gas tanker truck died in collision with another truck. Court ordered decedent's widow as administrator of his estate, to pay $206,914 to decedent's employer, in satisfaction of its lien against damages recovered by estate in underlying tort action. Court properly denied employer's request for portion of interest on underlying judgment. Employer's right to reimbursement for workers' compensation benefits was not triggered until widow obtained judgment in underlying action and defendant's insurer had satisfied that judgment six years later. Thus, employer, which had a lien and not its own judgment, was not entitled to any interest that accrued between the judgment date and the date of satisfaction of judgment. (HOFFMAN and DELORT, concurring.)
