Illinois Appellate Court
Civil Court
Contribution
Driver, whose passenger had filed personal injury action for rear-end collision, filed suit against a co-defendant, who then filed third-party complaint for contribution per Contribution Act, asserting that other driver negligently caused his vehicle to strike the vehicle in front of him and suddenly stop, which then caused Defendant's vehicle to strike Plaintiff's vehicle. Court entered good-faith finding as to $3,000 settlement between driver and his passenger. Evidence did not show collusion or wrongful conduct, or close personal relationship between settling parties, and evidence did not show that driver was primary or substantial cause of accident. (McBRIDE and TAYLOR, concurring.)
