Forcible Entry & Detainer
Court, in forcible entry and detainer action, granted possession of real property in favor of charitable foundation which had acquired property before Defendants' lease expired. Court properly granted possession of property, as closing did not occur within 90 days after Defendants accepted offer to purchase property, as lease required, and Defendants did not tender payment or earnest money. Notice to vacate adequately informed Defendants that Plaintiff wanted it to leave the premises, and circumstances indicate that Plaintiff did not intend to extend lease. Thus, Plaintiff did not create a holdover tenancy.(McBRIDE and HOWSE, concurring.)
