Court properly granted Park District's application, under Park Commissioners Land Sale Act, to sell two parcels of land in park. Court had jurisdiction to hear application because application was for less than 3 acres of park land. Land Sale Act is constitutional and does not violate Separation of Powers clause. Park District's decision that land was no longer needed, useful, or necessary and that its sale would be for public interest was not arbitrary and capricious. (McBRIDE and TAYLOR, concurring.)
