Cab company sued bank for breach of contract as to sale of two taxicab medallions, and court awarded Plaintiff $37,550 in damages after bench trial. Plaintiff appealed court's pretrial entry of partial summary judgment, where court determined that damages would be based on medallions' prices at time of breach, which could not have occurred after Plaintiff filed its complaint. Court's measure of damages was proper for this breach of contract as to sale of personal property available for purchase in the market.
