Attorney's Fees
Plaintiff law firm referred two workers' compensation cases to an attorney, with Plaintiff to receive 45% of attorney fees with Defendant attorney to receive 55% of fees, but Defendant never paid Plaintiff. Workers' Compensation Commission has authority to set amount of fees to be awarded to attorneys representing claimants before the Commission, and to resolve disputes as to fees, but is without authority over breach of contract dispute as to referral agreement between two attorneys.
