Sexual Assault
Defendant was convicted, after bench trial, of aggravated criminal sexual assault and aggravated criminal sexual abuse. Court engaged in meaningful analysis of all three statutory factors in line with established case law. Thus, no abuse of discretion in admission of other-crimes evidence of Defendant's aggravated criminal sexual assault charge as to another victim six months prior. Two attacks were factually similar: Defendant approached each victim at night in his car, forced them into car and gunpoint and then robbed and assaulted them. Acquittal on prior charge under "beyond a reasonable doubt" standard of proof did not bar subsequent admission of other-crimes evidence, governed by lower "more than a mere suspicion" standard of proof.
