Illinois Appellate Court
Criminal Court
Sentencing
Defendant was convicted, after bench trial, of two counts of possession of controlled substance with intent to deliver and sentenced to two concurrent terms of 11 years. State sufficiently proved intent to deliver through evidence of quantity recovered, packaging, and officers' description of attempted drug
transaction. Sentence appropriate as it fell within the statutory range and trial court considered all mitigating and aggravating factors. Two convictions do not violate one-act, one-crime principles because actual possession of first set of drugs and constructive possession of second set of drugs were separate acts. (LAVIN and MASON, concurring.)
