Case Number:
2015 IL 118254
Decision Date:
Thursday, September 24, 2015
District:
1st Dist.
Division/County:
Cook Co.
Holding:
Appellate court affirmed; remanded.
Justice:
THEIS
Defendant, doing business as Brookfield Zoo, is not a "local public entity" under Tort Immunity Act, so that Tort Immunity Act's one-year limitations period did not apply to Plaintiff's negligence complaint for injuries from trip and fall on paved pathway in zoo. Because Forest Preserve District does not exercise operational control over the Defendant, Defendant is not a "local public entity" under Section 1-206 of Tort Immunity Act. (GARMAN, FREEMAN, THOMAS, KILBRIDE, KARMEIER, and BURKE, concurring.)
