Charitable endowments are crucial for the support of charities providing health care, education and other basic human services. Without endowments, most charities could not exist. But endowments are very complex entities, involving a maze of legal, tax and accounting requirements. They have also drawn increasing scrutiny from state attorneys general, the IRS and donors after several recent high-profile instances of abuse. This program will cover recent changes to the law governing charitable endowments, provide a framework of decision points for attorneys advising charities on establishing a new endowment or restructuring an existing one, releasing or modifying donor restrictions on funds, discuss officer and director financial liability, and review the law governing the investment of charitable funds. Part 2 of 2.

Melinda A. Agsten is a partner in the New Haven, Connecticut office of Wiggin and Dana, LLP, where she chairs the firm’s tax exempt practice group. She has extensive experience advising health care, educational and other tax exempt organizations on corporate, governance, federal and state tax exemption, and regulatory matters.  She has been named by the health care category of “The Best Lawyers in America” every year from inception of the category. She is past president of the Connecticut Health Lawyers Association and a member of the Committee on Exempt Organizations of the ABA Tax Section. Ms. Agsten received her A.B., magna cum laude, from Duke University and received her J.D. from Vanderbilt University.

David T. Leibell is a partner in the Stamford, Connecticut office of Wiggin and Dana, LLP, where he has an extensive estate, trust and charitable giving practice. He previously worked in the financial services industry, specializing in the financial aspects of estate planning.  Mr. Leibell is a frequent lecturer on fiduciary topics throughout the United States, and has authored many articles on charitable, estate and tax planning topics.  He is the author of a monthly column in “Trusts & Estates” magazine.  He also authors a column for “Registered Representative Magazine.”  Mr. Leibell received his B.A. from Trinity College and his J.D. from Fordham Law School.
