Social media – Facebook, LinkedIn, Twitter, blogs, YouTube, Google and more – have permeated the way employers assess, communicate with, and manage prospective, current and former employees. Online background checks using Google or social media are commonplace for job applicants. Employee use of social media to communicate with co-workers and the outside world is pervasive. Former employees often ask for references using LinkedIn and other professional job-seeking sites. These and other employer and employee uses of social media have, seemingly overnight, fundamentally altered the legal landscape of the workplace in new and unexpected ways. This program will provide you with a real-world guide to employer liability for social media usage in the workplace and for background checks on job applicants, and best practices to reduce risk and limit liability.
