- 10:30 – 11:00 a.m. – The U.S. Department of Education’s Office for Civil Rights’ “Dear Colleague Letter”
On October 26, 2010, the U.S. Department of Education’s Office for Civil Rights addressed a letter to State Departments of Education and Local School Districts implying that those agencies are not doing enough to respond to bullying and harassment in the educational setting. Further compounding this implication, the Office for Civil Rights now states that a school district may be violating Title VII of the Civil Rights Act of 1964 if it is not doing enough to prevent the creation of a hostile environment by tolerating bullying and harassment that is based upon race, color, national origin, or disability. This segment examines the issues raised by the Office for Civil Rights and engages attendees in a discussion of what schools can do to prevent such violations from happening.

The July 1, 2010 Illinois Human Rights Act amendments extend the prohibition against unlawful discrimination and sexual harassment to the school districts. As a result, victims of such harassment may now gain access to the Department of Human Rights’ process of investigation and administrative hearings. In this presentation, the speakers provide a comprehensive overview of these changes and offer advice to educational lawyers and school districts on the new right to State administrative action.

Public Act 096-1087 (effective January 1, 2011) gave Juvenile Courts the jurisdiction to institute procedures for authoritative intervention for minors involved in electronically disseminating indecent images, also known as “sexting.” This segment provides a general update on the changes to the law and an overview of how attorneys can help a client that’s charged with this offense.
