Court rules panel conducts hearing on list of proposals
The Illinois Supreme Court Rules Committee conducted a hearing on April 17 in Chicago for comments on several proposals. The rules that were discussed are:
Rule 12(b)(3) – To allow proof of service by delivery to a third-party commercial carrier by stating time and place of delivery, complete address on the package, and that a proper delivery charge was paid.
Rule 304(b) – Adding paragraph (6) to make certain that judgments involving custody, adoption and termination of parental rights are appealable, even if other matters remain pending, such as support, property issues and rights of persons other than the child.
Rule 306A – In expedited child custody appeals, to add language consistent with that in Rule 304(b)(6).
Rule 307 – To allow an interlocutory appeal from an order denying a motion to dispose under the Citizen Participation Act.
Rule 341(h) – To require that an appellant’s brief provide clear and exact reference to pages of the record where a party preserved each issue in the trial court, and require counsel to state why the issue should not be forfeited when not preserved.
Rule 373 – To allow effective filing of records, briefs or other documents by delivery to a third-party commercial carrier on or before due date with delivery to the clerk within three business days after due date, with proof of delivery consistent with Rule 12(b)(3) proposal.
