Bd. did not err in affirming IJ’s denial of asylum application by alien (native of India) who alleged that he suffered past persecution on account of his Muslim religion when members of Hindu religion attacked him over 4-year period due to their belief that he and others had played role in train accident involving Hindu victims. Alien failed to show that India’s govt. either condoned said acts against alien or that govt. was helpless to prevent it. Ct. further noted that alien had failed to seek any assistance from govt. authorities while he was in India and had failed to file any formal report with respect to what he claimed happened to him while in India.
