Record contained sufficient evidence to support Bd.’s denial of asylum and withholding of removal applications based on claim that local Indian criminal group subjected alien to persecution on account of his political affiliation after alien had testified in murder trial against member of group. While record showed that alien received anonymous threatening phone calls on regular basis indicating that he would be “finished,” and that alien’s home had been attacked by individual throwing rocks, such conduct was too tepid to establish past persecution, given fact that alien did not incur serious harm. Moreover, alien had failed to establish requisite nexus between adverse conduct and his political affiliation. Fact that local Indian police officials had withdrawn special protection for alien’s family home after different political party had come to power did not require different result.
