Record contained sufficient evidence to support Bd.’s denial of aliens’ applications for adjustment of status, asylum, and withholding of removal based upon its finding that alien’s participation in 2002 military mutiny in his home country of Niger was tantamount to “terrorist activity” that precluded alien from obtaining any of his requests under 8 USC section 1182(a)(3)(B). Record supported finding that alien played role in planning said mutiny that resulted in seizure of regional governor in order to demand changes in Niger govt. Moreover, Bd. could properly reject alien’s claim that mutiny was essentially peaceful protest, where newspaper reports at time of incident described mutiny as armed uprising.
