Diadenko v. Folino

Federal 7th Circuit Court
Civil Court
Case Number:
No. 12-3091
Decision Date:
December 19, 2013
Federal District:
N.D. Ill., E. Div.
Dist. Ct. did not err in granting defendant-employer’s motion for summary judgment in section 1983 action alleging that defendant disciplined plaintiff-special education teacher in retaliation for plaintiff drafting letter to Chicago Mayor that was critical of defendant’s special education practices in plaintiff’s school. Plaintiff failed to present evidence that contents of letter played role in issuance of discipline, where: (1) first suspension occurred prior to date letter was drafted; and (2) plaintiff failed to show that relevant decision-maker was aware of letter at time second suspension was issued.
