Case Number:
Nos. 15-1141 & 15-3695 Cons.
Decision Date:
August 17, 2016
Federal District:
Petition for Review, Order of N.L.R.B.
Holding:
Petition denied and Cross Petition for Enforcement of Order granted.

Record contained sufficient evidence to support Bd.’s finding that petitioner-employer had engaged in unfair labor practices by threatening to fire employees for striking and by transferring work from Illinois to Mexico in retaliation for said strike. Company official warned employees that if they continued to strike company would transfer work to foreign facility and threatened to fire half of employees on first day of strike. Moreover, company official told striking employees that company was moving work to Mexico “because of the situation.” Ct. rejected employer’s claim that Bd.’s order could not be enforced since there was at most only negligible transfer of work, since: (1) required proof on extent of transfer comes at later stage of proceedings; and (2) instant record suggested that 22 of 94 employees could not return to work in part because of transfer of work to Mexico.
