Joe Sanfelippo Cabs, Inc. v. City of Milwaukee

Dist. Ct. did not err in granting defendant--City’s motion to dismiss plaintiffs-taxi companies’ action alleging that defendant’s new ordinance, which removed cap on number of taxi permits, essentially took property away from plaintiffs without compensation in violation of 5^th Amendment. Instant taxi permits did not create right to exclude others from operating taxi cabs. Fact that prior 1992 ordinance froze taxi permits at certain level did not require different result, since said ordinance did not confer any property rights on plaintiffs where said ordinance was susceptible to being repealed at any time.
