Ct. of Appeals dismissed as moot alien’s appeal of Bd.’s order that denied alien’s request to postpone removal proceedings (arising out of charge of being in U.S. without permission) for purpose of obtaining documents to expunge his drunk driving conviction in effort to convince Dept. of Homeland Security (DHS) to drop his removal proceedings. While alien eventually had his drunk driving conviction expunged, DHS subsequently determined that it would not exercise its discretion to drop alien’s case. As such, since alien never sought withholding of removal relief and was ineligible for cancelation of removal relief, instant appeal was moot because alien could obtain no meaningful relief arising out of his appeal.
