Dist. Ct. did not err in granting defendant-employer’s motion for summary judgment in plaintiff-employee’s Title VII reverse discrimination action alleging that African-American co-worker received more pay than plaintiff even though both individuals performed similar work for defendant. Record showed that: (1) no one in plaintiff’s Dept. had control over what employees in Dept. were paid; (2) employee’s pay in plaintiff’s Dept. was determined by what employee had made in different Dept. prior to transferring into plaintiff’s Dept.; and (3) both white and African-American co-workers in plaintiff’s Dept. who performed duties similar to plaintiff were paid less than plaintiff. Plaintiff also failed to present any direct evidence of anyone making racial comments towards plaintiff to otherwise show that race contributed to disparity in pay between plaintiff and his proposed comparable co-worker.
