Dist. Ct. did not err in denying plaintiff’s motion for issuance of preliminary injunction in action under National Environmental Policy Act and other similar statutes, where plaintiffs (who opposed both decision by Barack Obama Foundation to build Obama Presidential Center in Jackson Park in Chicago, as well as decision by City of Chicago and Chicago Park District that approved Foundation’s decision) alleged that various environmental reviews performed by federal agencies were inadequate because said agencies failed to consider alternatives to Jackson Park site. Ct. of Appeal, in affirming Dist. Ct., held that plaintiffs were unlikely to prevail on merits of lawsuit, where federal law did not require instant federal agencies to waste time and resources by considering alternative sites when evaluating environmental effects of proposed site, under circumstances where none of federal agency defendants had any authority to move project elsewhere.
