Equal Protection
Illinois Employee Classification Act does not violate constitutional principles of equal protection and special legislation by limiting application to construction industry. State has legitimate interests in preventing misclassification of employees as independent contracts to prevent employees from losing benefit of worker protection laws, including minimum wage, discrimination, and occupational safety laws; and in revenues from unemployment insurance contributions and payroll taxes; and in ensuring that contractors who properly classify employees are not at competitive disadvantage to contractors who misclassify employees. Provisions of Act are rationally related to those legitimate State interests. (GOLDENHERSH and CHAPMAN, concurring.)
