Illinois Appellate Court
Civil Court
Employment Contract
(Court opinion corrected 9/5/12.) Plaintiff investment analyst was given Formal Warning after "mooning" two superiors, but was then terminated upon opinion of CEO that behavior was egregious and harmful to company and leadership. Plaintiff violated employee handbook rule and regulations by behaving in disruptive, unruly, and abusive manner, and thus violated his duties as employee. Thus, Plaintiff was justly terminated for cause. Formal Warning was not a contract or promise of continued employment. Court properly entered summary judgment for Defendants. (NEVILLE and SALONE, concurring.)
