Forcible Entry & Detainer
Commercial landlord brought forcible entry and detainer action against tenant for back rent. Court found that landlord had not proven by preponderance of evidence that tenant owed rent at time of five-day notice, and landlord did not file notice of appeal within 30 days of that order. Tenant filed motion for fees and costs within 30 days, but it did not challenge findings in underlying judgment, and thus was not a posttrial motion directed against the judgment and thus did not extend the time period for appeal. (HOLDRIDGE and McDADE, concurring.)
