Turkish aviation company (which operates charter flights) and its crew members sued Defendants aircraft maintenance companies, alleging them liable for damages Plaintiffs suffered in accident during landing attempt by a leased aircraft that company was operating. After incident, Plaintiff entered into agreement with lease finance company and 2 affiliates, that modified terms of 5 lease agreements, including lease covering aircraft at issue; and a Release of all liability related to incident, including releasing all other entities not specifically identified. Court properly granted summary judgment for Defendants, based on the Release, as intention of parties was to eliminate any litigation arising out of incident.(ZENOFF and BIRKETT, concurring).
