Hopkins v. Board of Trustees of the Firefighters Pension Fund

Fire Department Captain filed application for line of duty disability pension, claiming that cumulative effects of 2 on-the-job head injuries caused him to be disabled. Circuit court properly found decision of Pension Board "clearly erroneous", and properly reversed Board and found Plaintiff entitled to line of duty disability. Pension Board's decision is against manifest weight of evidence as its decision selectively relies heavily on 1 medical expert's testimony to exclusion of other medical opinions and documentation.
