Fire Department Captain filed application for line of duty disability pension, claiming that cumulative effects of 2 on-the-jobĀ head injuries caused him to be disabled. Circuit court properly found decision of Pension BoardĀ "clearly erroneous", and properly reversed Board and found Plaintiff entitled to line of duty disability. Pension Board's decision is against manifest weight of evidence as its decision selectively relies heavily on 1 medical expert's testimony to exclusion of other medical opinions and documentation. Plaintiff met his burden of proof and established his right to a line of duty disability pension.(WELCH and CHAPMAN, concurring.)
