Illinois Appellate Court
Civil Court
Telephone Consumer Protection Act
Court properly granted summary judgment for Plaintiff on its Telephone Consumer Protection Act (TCPA) claim for having received, on 2 occasions, an unsolicited 1-page fax advertisement promoting Defendant's business. Evidence adduced in discovery shows owner of Defendant company gave its employee broad authority to make any decisions as to fax campaign, and this is sufficient to show faxes were sent "on behalf of" Defendant. (NEVILLE and SIMON, concurring.)
