Helia Healthcare of Belleville, LLC v. Norwood

Numerous plaintiffs, skilled nursing facilities in Illinois, filed complaint for declaratory and injunctive relief, alleging that Director of Healthcare and Family Services (HFS) acted in excess of her authority by directing that HFS calculate Medicaid rate reductions using all funds rather than limiting reductions to appropriations from General Revenue Fund. Court of Claims holds exclusive jurisdiction over matter, and court properly dismissed cause for lack of subject matter jurisdiction. Section 5-5b.1 of Public Aid Code imposes a specific amount of reimbursement reductions to be made for fiscal year 2015, but leaves it to Defendants to determine how to reach that amount.(FITZGERALD SMITH and COBBS, concurring.)
