Illinois Appellate Court
Civil Court
Tort Immunity Act
Plaintiff filed suit against City for injuries sustained when she tripped and fell on a sidewalk maintained by City. Plaintiff alleged that her fall was proximately caused by City's failure to repair an uneven seam between 2 slabs of concrete on sidewalk. Court properly granted summary judgment, finding City was immune under Tort Immunity Act. Plaintiff challenged discretionary actions and policy decisions of City administrators, for which City is immune under Sections 2-109 and 2-201 of Tort Immunity Act. (HOLDER WHITE and POPE, concurring.)
