Petitioners sought judicial review of Illinois Commerce Commission decision granting certificate of public convenience and necessity to Indiana company formed to construct and manage a high voltage electric service transmission line to connect wind generation facilities. Commission failed to make requisite finding that applicant was a public utility, and erred in granting a nonpublic utility company the authority to construct and manage line project under the Public Utility Act's expedited review process in Section 8-406.1 of the Act.(GOLDENHERSH and CHAPMAN, concurring.)
