Motions to Dismiss
Plaintiff filed complaint for civil rights violations against IDOT. State filed Section 2-619 motion to dismiss, which court granted, but did not file an Answer. Plaintiff failed to respond to allegations in Section 2-619 motion as to statute of limitations bar and failure to state cause of action, and thus he forfeited those arguments. State was not required to file Answer, as it filed Section 2-619 motion to dismiss (HARRIS and DeARMOND, concurring.)
