Plaintiff sustained serious injuries at work while cleaning a machine, and filed suit against multiple parties. All Defendants except ITW were dismissed or entered into settlement with Plaintiff. Plaintiff alleged that ITW owed a duty to him as a member of a joint venture with his employer. ITW, as a member of the joint venture, is an agent entitled to the same immunity afforded to Plaintiff's employer by the exclusive-remedy provision of the Worker's Compensation Act, regardless of whether ITW specifically paid workers' compensation benefits for the joint venture.
