Respondent Brickyard filed permit application with Illinois EPA to modify design of its landfill to allow a "wedge" area to be filled with municipal solid waste. EPA denied application. Illinois Pollution Control Board granted Brickyard's motion, as Brickyard was not required to obtain local governmental approval, as it was not seeking to expand boundaries of its pollution control facility. No statutory language indicates that local siting approval is necessary for inner workings of an operating pollution control facility. (HARRIS and STEIGMANN, concurring.)
