Illinois Appellate Court
Civil Court
Estates
A non-attorney proceeding pro se petitioned court to open an estate for his mother, who died without a will, and to be appointed as administrator of her estate.Court properly dismissed petition; Petitioner cannot represent the legal interests of his mother's estate as he is not a licensed attorney or a party to this suit. Petitioner cannot, as it appears he intends to do as independent administrator, pursue claims against his sister for allegedly dissipating estate's assets. Petition for Letters of Administration forms, as mentioned in dissent, are from other counties and are thus inapplicable. Appellate court dismissed Petitioner's appeal and struck his brief. (MASON, concurring; HYMAN, dissenting.)
