Citation to Discover Assets
Plaintiffs registered, in Cook County, a California Superior Court judgment of $1.675 million against debtors, and filed citations to discover assets on them. Lawyer for debtors refused to reveal the identity of the 3rd-party client who was paying for their representation. Neither attorney-client privilege nor Rules of Professional Conduct shield the identity of that 3rd-party client. Court properly entered motion to compel disclosure of identity of client, and holding attorney in contempt. Plaintiffs must put forward some evidence that the 3rd-party possesses assets of the judgment debtor, but cannot do so until they know the 3rd-party's identity.(LAVIN and PUCINSKI, concurring.)
